The concept of Chain or Responsibility was incorporated within the Road Transport (General) Act 2005, which commenced in October 2005. For the first time, all parties in the road transport supply chain – including the consignor, consignee, packer, loader and receiver, as well as the driver and operator – must take positive steps to prevent a breach of the road transport, fatigue, speed, mass, dimension and load restraint laws.

The aim of the chain of responsibility is to ensure that all who bear responsibility for conduct which affects compliance should be made accountable for failure to discharge that responsibility. Driving hours regulations now contain serious offences for persons who require drivers to adhere to schedules, which would result in driving hours or speeding offences. These offences apply in particular to consignors and employers who require drivers to operate under unreasonable conditions.
To support the enforcement of the chain of responsibility, new inspection and search powers were introduced in Victoria on 1 July 2003.

Under Chain of Responsibility, everyone in the supply chain is responsible for preventing driver fatigue. If you exercise control or influence over the transport activities in your workplace, you can be held legally liable for your actions, inactions or demands if they cause or contribute to a road safety breach. The law requires you to take reasonable steps to prevent contributing to a breach.

The concept of Chain of Responsibility came into force in 2007 (along with other amendments to laws, designed to encourage safe work practices and fairness across the total transport task, where everyone takes appropriate responsibility for the way goods are moved on our roads.)
In South Australia, Chain of Responsibility extends legal liability of road law offences to all parties who by their actions, inactions or demands exercise control or influence conduct on the road.

The forthcoming Compliance and Enforcement (C&E) legislation introduces the concept of ‘chain of responsibility’ to recognise all parties that have a role in the transportation of goods by road. Draft legislation was introduced into State Parliament in 2008, part of the legislation has been passed by Parliament and the remainder of the legislation is currently being worked on.
Employers may choose to use AVELING's Chain of Responsibility course as part of their Risk Management plan, to educate off-road parties and drivers about their responsibilities for fatigue management, speed management and load size, dimension and weight limit.

The Australian Capital Territory did not implement Chain of Responsibility legislation, but will recognise accreditation in other jurisdictions. Employers may choose to use AVELING's Chain of Responsibility course as part of their Risk Management plan, to educate off-road parties and drivers about their responsibilities for fatigue management, speed management and load size, dimension and weight limit.
Chain of Responsibility legislation is not currently in force in Tasmania, but companies operating outside of Tasmania may be affects by these laws in other states/territories. Employers may choose to use AVELING's Chain of Responsibility course as part of their Risk Management plan, to educate off-road parties and drivers about their responsibilities for fatigue management, speed management and load size, dimension and weight limit best practice.
It is anticipated that the Northern Territory will introduce the concept of Chain of Responsibility in 2013, when the new National Heavy Vehicle Regulator (NHVR) is introduced. In the meantime, employers may choose to use AVELING's Chain of Responsibility course as part of their Risk Management plan, to educate off-road parties and drivers about their responsibilities for fatigue management, speed management and load size, dimension and weight limit.
