Under WA’s WHS Act (2020), Schedule 26 of the WHS (Mines) Regulations 2022 outlines various statutory positions for which individuals must meet requirements, including completing Units of Competency (UoC) and/or passing a law examination administered by the Department of Energy, Mines, Industry Regulation and Safety (DEMIRS).*
This course has been developed to help prepare you for these new requirements and provide you with the confidence to successfully undertake your exam.
We will guide you through how to read and understand the WHS legislation and the skills to navigate it during your exam. You will gain an understanding of Statutory Positions including Key Positions and Schedule 26 roles, and eligibility and acceptance of a Statutory Position.
We will also cover how to register and navigate the Mine Statutory Position Portal (MSPP), and how to approach answering the exam questions. You will get the opportunity to practice answering exam questions, and benefit from three months’ access to comprehensive practice exam questions on our online portal.

This course takes place over one day at our Jandakot facility.
We will first cover an overview of the WA Work Health and Safety Act 2020 and WA Work Health and Safety regulations (Mines) 2022, Statutory Positions including Key Positions and Schedule 26 roles, and eligibility and acceptance of a Statutory Position.
You will then be guided through how to effectively read and reference the legislation, how to register and navigate the Mine Statutory Position Portal (MSPP), and how to approach answering the exam questions.
You will have access to Aveling’s online practice exam questions for a period of 3 months after the course to continue your preparation before you take the exam.
